SilviaK (silvia.fitness) Terms & Conditions

Effective Date: 25 August 2025

  1. Introduction


SilviaK (silvia.fitness) provides in-person, live online, and on-demand fitness classes. By booking or participating in any class, you agree to these Terms & Conditions, which form a binding agreement between you and SilviaK (silvia.fitness).


If you do not agree with these terms, you should not use the services. These terms may be updated from time to time, and continued use of the services indicates acceptance of any changes.

  1. Bookings, Attendance & Cancellation Policy


Booking and Payments:

  • All classes must be paid for in advance via the online booking system.

  • Bookings are confirmed once payment is received.

  • Spaces are limited and available on a first-come, first-served basis.


Transfers and Rescheduling:

  • In-Person Classes: Can be transferred to another date up to 24 hours before the class starts.

  • Live Online Classes: Can be transferred up to 12 hours before the class starts.

  • On-Demand Classes: Access is provided upon payment and is non-refundable.

  • Transfers must be made via personal account. Login to your account, go to "My Bookings", then select "Manage" next to the class. Choose the reschedule or cancel option.


Missed Transfers and Required Cancellations:

  • If you are within the 24-hour (in-person) or 12-hour (online) window and can no longer attend, you must cancel your booking via your account. This helps us open your space to someone else.

  • Please note that bookings cancelled are non-refundable and non-transferable.


Late Arrivals and Resale Policy:

  • In-Person Classes: If you arrive more than 5 minutes late to a class without informing us at least 15 minutes before the start time, we may cancel your booking and offer your space to someone else.

  • Live Online Classes: If you arrive late, access may not be granted.

  • No refund or credit will be provided.

  • This policy ensures the class starts smoothly and respects the time of all participants.


Pay-As-You-Go Clients

  • Missed classes are non-refundable and non-transferable within the 24/12 hour cut-off period.

  • The client must reschedule within the allowed time via the original booking.


Subscription Clients

  • Subscription payments are taken automatically once per month and continue until cancelled.

  • You may cancel your subscription at any time; access will remain active until the end of the current paid month.

  • No refunds are given for unused time after a payment has been processed.

  • Missed classes are non-refundable. On-demand or live online access may be included in your plan if specified.

  • You are responsible for managing your subscription and bookings through your account.


Instructor Cancellations

  • If SilviaK cancels a class, a rescheduled session or a refund will be offered for pay-as-you-go clients.

  • Subscription clients can book for any other live or on-demand option, where available.

Programmes (Digital Content)

  • Programme purchases grant you personal access as described at checkout.

  • Programmes are for individual use only and may not be shared, copied, or resold.

  • As digital products, you will lose your right to cancel once access has been granted. Refunds are not available except where required by law (e.g. if the programme is faulty or misdescribed).

  • SilviaK Fitness is not responsible for individual results. Content is for general fitness and wellbeing purposes only and does not replace medical advice.

  • You are responsible for ensuring you are physically able to participate safely in any recommended activities.

  1. Shop (Merchandise)


Orders & Payments

  • All prices are in GBP (£). Payment must be made in full at checkout.

  • A refund processing fee may be deducted for refunds requested for reasons other than faulty or misdescribed goods.


Delivery

  • Orders are shipped to the address provided at checkout. Please check the details carefully.

  • Estimated delivery times are shown at checkout, but may vary.


Returns & Refunds


  • All eligible returns must be made within 7 days of delivery.

  • Items must be unused, in original packaging/condition, with tags attached.

  • Exclusions: custom-printed items on customer-supplied garments cannot be returned unless faulty due to the printing process.

  • Customers are responsible for return postage costs.

  • If you believe your item is faulty, please contact SilviaK Fitness at silviak@silvia.fitness with photos and details before posting it back. If confirmed as faulty, reasonable return postage costs will be reimbursed.

  • Refunds are processed once items are received and inspected..


Care Instructions


  • Fitness tops must be washed inside-out on a cool cycle, not tumble-dried, and ironed inside-out if needed.

  • Failure to follow care instructions may void your right to return/refund.


Liability


  • SilviaK is not responsible for issues caused by misuse, including improper washing or unsafe use of resistance bands.

  1. Health & Liability Disclaimer


IMPORTANT: CONSULT A DOCTOR BEFORE PARTICIPATING IN ANY FITNESS PROGRAM.


By participating in any SilviaK class, you confirm that:

  • You have no medical conditions that prevent you from exercising.

  • If pregnant, you have received medical clearance to participate.

  • You will stop immediately and seek medical attention if you experience discomfort, dizziness, any unusual symptoms or other health concerns.


Limitation of Liability:

  • Participation in any SilviaK fitness class or programme is at your own risk.

  • While all reasonable precautions are taken, SilviaK (silvia.fitness) is not liable for any injury, illness, or loss sustained during or after participation, except where caused by our negligence.

  • SilviaK does not provide medical advice. You are responsible for ensuring you are fit and able to participate and should consult a medical professional if unsure.

  • You are responsible for using any fitness equipment correctly and safely.

  • To the fullest extent permitted by law, SilviaK’s total liability to you shall not exceed the total amount paid for services in the three (3) months preceding any claim.


  1. Photography & Video Consent


  • On-demand classes: All on-demand classes are recorded by SilviaK Fitness and feature only the instructor.

  • Promotional use: In-person classes are filmed or photographed for promotional purposes. This will include recording participants during the class to capture the group energy. By attending, you agree that SilviaK Fitness may use such footage and images for marketing across websites, social media, and other promotional channels.

  • Opt-out: If you prefer not to appear in promotional material, please let me know before class begins, and I will make every effort to keep you out of frame.

  • Participant recording: Filming, photographing, or live streaming of classes by participants is not permitted without prior written permission.

  1. Online Classes & Technical Access


  • Live online classes are delivered via Zoom. Access is granted via a confirmation email.

  • You are responsible for your internet connection and device. SilviaK is not liable for connectivity issues or device failure.

  1. User Accounts & Conduct


  • You must be at least 18 years old to use SilviaK services.

  • You are responsible for safeguarding your password and managing your account activity.

  • Sharing your account or class links is not permitted.

  • Services are for personal use only. You may not record, redistribute, or resell any class content.

  1. Privacy & Data Protection


  1. Intellectual Property & Content Use


All class materials, videos, workout plans, and content are the intellectual property of SilviaK. You may not copy, reproduce, modify, or distribute any content without written permission.

  1. Governing Law & Dispute Resolution


These Terms are governed by the laws of England and Wales. Any disputes shall first be attempted to be resolved through mediation before resorting to legal action.

  1. Changes to Service or Terms


SilviaK reserves the right to modify, cancel, or adjust classes, schedules, pricing, and services at any time.

We may update these Terms from time to time. Any changes will be posted on our website, and continued use of the service constitutes your acceptance of the updated terms.
